1. Accepting the terms
By creating an account, accepting a team invitation, or using Gignal, you agree to these Terms, the Public Offer, and the Privacy Policy. If you disagree, do not use the service.
You confirm that you are at least 18 or otherwise have sufficient legal capacity to enter this agreement. You can contact the service operator using the address at the end of this document.
2. What Gignal does
Gignal helps freelancers and small agencies manage clients, contracts, time, invoices, transactions, forecasts, and estimated tax calculations. Results depend on the completeness and accuracy of data you enter or import.
Gignal is not a bank, payment system, accountant, auditor, lawyer, or tax adviser. The service does not file reports or pay taxes for you. Before submitting documents, verify the result yourself or with a qualified professional.
3. Account and team
- You are responsible for keeping your email current and your password, two-factor authentication, and recovery codes secure.
- The organization owner manages members and roles and is responsible for ensuring invited people are authorized to view workspace data.
- Do not share your credentials. If you suspect unauthorized access, change your password and contact support.
4. Plans, payment, and refunds
Plan features and prices are shown on the pricing page and before purchase confirmation. Creating an account does not itself start a paid subscription.
Paid access, cancellation, and refunds are also governed by the Public Offer.
Paid subscriptions are sold and processed by Paddle.com Market Limited as Merchant of Record: Paddle accepts payment, issues payment documents, and handles sales taxes. Paddle's buyer terms apply to the purchase: paddle.com/legal/buyer-terms.
You can cancel through your profile or support. Pro access continues through the paid period, after which the workspace moves to Free without deleting data. Refund requests are handled under Paddle's rules and mandatory consumer protections.
5. Your data
You retain rights to the workspace data you provide. You grant Gignal only the technical rights needed to store, process, display, and back it up to operate the service. You can export and delete data through your profile.
6. Client data and imports
By adding client or colleague data, bank documents, CSV reports, invoices, or other files, you confirm that you may process and provide them to the service. Do not upload unnecessary personal data or third-party files without a proper basis.
You act as controller of personal data that you place in the workspace and instruct Gignal to process it only to provide, secure, support, and improve the contracted service. You are responsible for informing affected people, choosing a lawful basis, handling their requests, and avoiding special-category, medical, biometric, secret, or unlawfully obtained data unless it is genuinely necessary and adequately protected.
7. Acceptable use
You must not use the service unlawfully, violate others' rights, access or try to access others' data, bypass authentication or plan limits, distribute malicious code, create excessive automated load, or resell access without the operator's written consent.
If you use Gignal for a business, you confirm that you have authority to bind it. To the extent permitted by law, a business customer will compensate the operator for third-party claims caused by its unlawful content, infringement of another person’s rights, or deliberate misuse of the service, provided the operator promptly notifies it and reasonably cooperates with the defence. This does not apply to claims caused by the operator.
8. Calculations and external sources
NBU rates, imported reports, payment-platform statuses, and tax rules may be incomplete, change, or arrive late. Forecasts, KPIs, tax calculations, and sole-proprietor limit estimates are aids, not guarantees of financial results or government acceptance of filings.
9. Intellectual property
The Gignal name, brand, bird character, design, copy, documentation, and software belong to the operator or their respective owners. You receive a limited, non-exclusive right to use the service as intended. This does not limit your rights to your own data.
10. Availability and backups
The service is provided as is and as available. Updates, maintenance, or failures of internet, hosting, email, payment, or external APIs may temporarily limit access. Backups support operational recovery, so regularly export important data for your own archive.
11. Liability
To the extent permitted by law, the operator is not liable for decisions based on service calculations, lost profits, tax assessments, penalties, input errors, or unavailable external services. The operator's total liability is limited to the amount actually paid for Gignal during the 12 months before the event. This does not limit consumer rights that cannot be waived by law.
No exclusion or cap applies where prohibited by law, including liability that cannot be limited for fraud, wilful misconduct, gross negligence, death or personal injury, or mandatory consumer remedies. Free-plan users retain all non-waivable statutory rights even though no subscription fee was paid.
12. Suspension and termination
You may stop using the service and delete your account at any time. We may restrict access where we reasonably suspect a breach of these Terms, fraud, a security threat, or where required by law. When safe and practical, we will explain why and allow you to export data.
13. Changes to these terms
The current version is always published here with its effective date. We will give at least 14 days' notice by email or in the product before material changes that reduce your rights or increase your obligations, unless the law requires another period.
14. Governing law, force majeure, and contact
Ukrainian law applies to these Terms. The parties should first try to resolve disputes through support; unresolved disputes go to a competent court. If one provision is invalid, the rest remain effective.
Neither party is liable for failure caused by circumstances beyond reasonable control, including hostilities, prolonged outages, cyberattacks, government action, or major infrastructure failures.
These Terms, the Public Offer, Privacy Policy, Cookie Policy, and the plan information shown at checkout form the entire agreement for the service. Failure to enforce a provision is not a waiver. The operator may assign the agreement as part of a lawful reorganisation or transfer of the service without reducing mandatory rights; you may not assign it where that would create security or compliance risk. Clauses that by nature must survive termination—including ownership, accrued payment, confidentiality, and liability—remain effective.
